Real Estate Law

Purchases and Sales

To ensure a smooth transaction of property it is best to hire an attorney soon in the process of buying or selling your home. From the sale contract, to inspecting the title, to the various items requested by the bank, and to documents required to be filed with the county and state, there are a number of items that must be properly situated prior to closing on the deal. Kimberly M. Wells, Attorneys at Law offers full-service real estate services and will work to bring about your purchase or sale of your next home in a smooth and timely manner.

Boundary Disputes

Boundary disputes are settled by bringing an action to quiet title before a court. If there is a boundary dispute or adverse possession claim against your property it will be extremely difficult to sell the land until these matters are taken care of. Similarly, if you have improved property that is argued to fall on your neighbor's property this will need to be addressed. This can arise when, for example, a garage or addition is constructed without a survey. Contact Kimberly M. Wells, Attorneys at Law to discuss your real property boundary issues or any claim that is being made to the title of your real estate.

Title Insurance

Kimberly M. Wells, Attorneys at Law act as agents for the issuance of title insurance. When you are purchasing property we will be able to handle all of your title needs in house without the need to involve a separate agent. Our attorneys also offer title searching and examination services to determine if there is any potential encumbrance to proper ownership of the land and title.

As the owner of a piece of property it is your responsibility to stay current on any outstanding mortgages and to pay your property taxes in a timely manner. This remains true even if your stream of income has been disrupted by tenants who do not pay their rent or cause damage to your property. Evictions in New York State are handled in court, and residential landlords may not engage in self-help practices to remove a tenant. Kimberly M. Wells, Attorneys at Law assists landlords with evicting tenants who are in breach of the terms of their lease.
