Contract Disputes

Parties to a contract can proceed with the confidence that performance of the terms by the opposite party is enforceable by the courts. Relief can be sought in the form of specific performance as agreed to in the contract, but more often result in the award of monetary damages to make the party harmed by the breach financially "whole" again. On the other hand, there are many times when the parties never saw eye to eye on the terms of the agreement in the first place. New York State does not require contractors to be licensed. While certain municipalities oversee their own licensing programs, in our geographical areas of practice it is typically the case that any individual may offer contracting services without specific training or bonding requirements. Unfortunately a small number of the individuals who do that are simply not very good, and poor craftsmanship puts your most valuable asset at risk. To combat this problem the Courts may award financial damages to reimburse homeowners for their loss. Conversely, it is occasionally also the case that a contractor has performed his or her job at a high level, but for one of many possible reasons the homeowner seeks reimbursement despite the contractor having completed the job to near-perfection.
